Dear Mr. President:

I am joining VelvetRevolution, an organization representing scores of voting rights and electoral reform organizations, in their grave concerns about the recently announced Baker/Carter Election Reform Commission. Specifically, we believe that the inclusion of James A. Baker, III as co-chair is wholly inappropriate for such a commission due to his actions as the lead attorney for Bush/Cheney 2000 and his strategy to ensure that the votes of all Americans would NOT be counted in the 2000 election in Florida.

Obviously, there is a profound need for electoral reform in the United States since our recent elections are viewed worldwide as flawed and as controversial as those of countries we condemn. Indeed, citizens in America have no constitutional right to vote, no national standards for how votes are recorded and counted, and most troubling of all, no way to verify computer tabulated votes. The confidence crisis concerning the transparency and accuracy of our elections has now reached epidemic proportions and has led to a cynicism and distrust of the entire electoral process. Clearly, a blue-ribbon commission with the stature of the 9/11 Commission is needed to ensure the changes necessary for trustworthy elections.

Mr. Baker, however, as a long-time partisan and Bush Family loyalist, can never be seen as an honest broker in this area. Frankly, his participation on the Commission is an insult, and even a slap in the face, to those of us who are truly concerned about America's democracy, and who understand the desperate need for real election reform.

Accordingly, we are calling for Mr. Baker to step down immediately from this post, and we hope that you will join us in this most urgent and necessary call.

Moreover, at least two other commissioners have direct ties to Mr. Baker’s Baker/Botts law firm, which is an equal conflict of interest. Tom Phillips worked for the firm and, in fact, swore in George W. Bush when he was Governor of Texas. Robert Mosbacher’s company, Mosbacher Energy Company is represented by the firm as well. Additionally, commissioner Ralph Munro appears to have two conflicts of interest – first, he has made public statements in support of a revote for Republican Dino Rossi in the recent Washington Governor race and he is Chairman of the Board of the voting machine company, VoteHere, which is pushing a particular type of vote verification over paper ballots.

As well, we are simply astonished by the inclusion of Mark F. "Thor" Hearne as an Academic Advisor to the Commission. Mr. Hearne recently formed a "non-partisan" organization called the "American Center for Voting Rights" (ACVR) which claims tax-exempt 501(c)3 status, and yet is anything but "non-partisan.” Mr. Hearne was the National Counsel for Bush/Cheney 2004 and is a hard right partisan. ACVR is a phony GOP front group formed by Bush/Cheney and RNC operatives (including the 2004 Communications Director for the RNC!) to engage in an insidious propaganda campaign to distract Americans from true electoral irregularities. Mr. Hearne has even stated publicly that there is no proof that any electoral problems occurred in Ohio this year except for improper voter registrations by liberal organizations. It is outrageous that the head of such a cynical organization is advising this Commission, while the broad spectrum of legitimate and established voting rights and election reform organizations are not represented.

Mr. Baker, Mr. Phillips, Mr. Mosbacher, Mr. Munro and Mr. Hearne are five obvious people who should never have been considered for this Commission. Unfortunately, due to the secret manner in which the Commission was put together, we have little doubt that other Commission members and advisors will be found equally inappropriate.

It is my understanding that Congressman John Conyers of the U.S. House Judiciary Committee recently wrote to you to express some of these same concerns. Clearly, many people – the millions of Americans who love democracy and have been tirelessly fighting to save it against the current onslaught from the Voting Machine Companies and others who are spending millions to keep the world's greatest democracy from having a world-class, transparent, trustworthy and verifiable voting system -- will be closely following every aspect of the Commission’s work. We will be hoping you will issue a report with real recommendations that will re-establish our role as a model for the rest of the world. But things are not off to a good start, and we fear that if changes are not made immediately, the important work of this Commission will be diminished, disregarded, sullied and forever deemed illegitimate.

America deserves much better.

In lieu of Mr. Baker leaving this commission, we hope that you will consider doing so in honor of all of the freedom fighters who have given their lives for true voting rights, democracy and inclusion in this country throughout our history, and throughout the world. Your tireless work and excellent reputation on behalf of democracy is too important to be damaged by mingling with disingenuous partisans and their paid cronies whose agenda is to limit voting rights and electoral reform. American citizens deserve much better. Please take notice, and please take a stand!
